1- Payments

1/a- The entire reservation fee must be paid to the Agency during registration. If the specified payments are not made within the mentioned periods, the reservation(s) made will be canceled and P (fifty percent) of the total reservation fee will be invoiced to the consumer as withdrawal compensation.

1/b- The consumer who purchases a discounted service (makes a reservation) is obliged to pay the full total amount at the time of registration.

1/c- For early reservations and promotional reservations, the full reservation fee must be paid at the time of reservation. Withdrawal compensation is the same as in Article I/A.

2 - Cancellation & Transfer

Although the agency has taken all necessary care, it prevents the start or continuation of the trip; Lack of accurate registration for the required number of passengers, the hotel falling into short supply or the hotel not accepting reservations for certain reasons and/or adverse weather conditions, road obstacles, strikes, terrorism, fog, possibility of war, economic and administrative crises, unforeseen technical issues and all force majeure reasons. may cancel or postpone the trip. In this case, the consumer has no right to compensation.

2/a- When the consumer requests cancellation up to 30 days before the start of the service, the entire amount paid will be refunded to him/her.

2/b- If the consumer cancels the contract 30 (thirty) - 15 (fifteen) days before the start of the service-accommodation, 5 (thirty-five) of the total reservation fee will be paid, and if the consumer cancels the contract 15 (fifteen) -7 (seven) days before the start of the service, the total reservation fee will be paid P (fifty) and, if less than 7 (seven) days before, the entire amount is paid to the agency. Date changes made by the consumer have the effect of cancellation.

2/c- If the consumer wants to cancel the Early Booking Discounted Product purchased during the discounted sales period for any reason, he/she will be charged the full cost of the trip if he/she has not taken out cancellation insurance. 2/d- The exception to the cancellation/transfer clauses is the written submission of the consumer before the start of the service, along with the official board report obtained from a full-fledged state hospital, regarding the illnesses or deaths of the consumer or his/her first-degree relatives that prevent him/her from normal activities for 10 (ten) days.

2/e- The consumer can transfer his/her reservation to the person he/she wishes up to 7 (seven) days before the start of the service. The transferee is responsible, together with the transferor, for the balance and all expenses arising from the transfer. The consumer is obliged to submit all cancellation/transfer requests to the agency in writing before the start of the service.

2/f- If the consumer does not notify in writing that he will participate in the service-accommodation that he missed the start of; The agency has the right to cancel all reservations and services made on behalf of the consumer after 24 (twenty-four) hours. In such cancellations, no refund will be made to the consumer.

2/g- If deemed necessary, the Agency may partially or completely cancel the reservations it has announced or recorded before the start of the service, provided that it notifies the Consumer. During the same period or during the service-accommodation, the agency may change the names of the hotels within the scope of the service, the means of transportation and their departure locations, and the order of visits of the places specified in the program and shown as places to visit. If the consumer does not accept these changes and cancellations for justified reasons, he has the right to cancel his reservation and receive a refund of unconsumed service fees.

2/h- Consumer; If, for any reason, he/she wishes to change the date of the discounted early booking product purchased during the discounted sales period, he/she accepts that the reservation change will be made without a discount at the list prices valid on the date of the request.

2/ı- If the consumer abandons the tour on the grounds that the service is defective, he/she must notify the Travel Agency representative and the hotel where he/she is staying in writing, along with the reasons, that he/she abandoned the tour. Otherwise, the consumer is not considered to have abandoned the tour and is deemed to have received and used the service.

2/j- If the consumer uses the tour program he purchased to the fullest even though he complains, it eliminates his rights to compensation such as substitute service and refund regarding the issues he complains about.

3- General Provisions

3/a- All responsibility regarding the baggage and its contents belongs to the baggage owner. The consumer is obliged to comply with the laws and practices governing the vehicle in which he will travel and the facility in which he will stay.

3/b- In cases of baggage loss or damage caused by the gross negligence of transportation service providers; If the consumer has the provider draw up a REPORT of loss or damage, 1/2 of the part of the total cost of the trip corresponding to transportation, regardless of the material and moral value of the items in the luggage and their other characteristics, will be paid by the agency as material and moral compensation for the lost items and luggage. It is paid to the consumer who owns the goods. The agency is responsible for any loss, damage or theft of the goods received, having been declared to it in writing, together with their value, up to the transportation cost of the total reservation amount. In addition, in case of loss or damage of luggage or goods that occurs during the accommodation service or on the day of departure, the consumer will file a REPORT of loss or damage. In addition, the agency is not responsible for making any payments in case of such losses or damages.

3/c- VISA PROCEDURES and SERVICES are not included in the purchased services and accommodation amounts.

3/d- The agency is responsible for reasons other than force majeure that occurs after the start of the service it has undertaken, situations for which the consumer is responsible, and situations arising from the personal responsibilities of third parties. In cases within the responsibility of the Agency, it may compensate the Consumer for changes that are against the Consumer in the form of a fee or service refund in accordance with the provisions of the TÜRSAB Kütahya Schedule, or it may also seek compensation through additional and/or alternative arrangements not included in the price and provided to the Consumer during the service. . In addition, it can be compensated by giving additional discounts at the rate/amount offered by the Agency due to another trip of the Consumer. The fact that additional, substitute services or additional discounts have been received, used or consumed by the Consumer eliminates the Consumer's rights to a refund and compensation.

3/e- The consumer shall comply with the rules declared by the guide, facility, agency and transportation vehicle authorities regarding the purchased service; He accepts that he will respect the life, property and peace of third parties, otherwise he will not be able to receive the service for justified reasons and he has no right to return.

3/f- If the consumer terminates the reservation because the service provided is defective, the consumer must notify the agency representative and the hotel he/she is staying in in writing about the reasons for termination. Otherwise, it is considered as having received and used the service.

3/g- It is the duty of the well-intentioned consumer to cooperate and act diligently by notifying the agency in writing about the issues the consumer is complaining about during the performance of the service.

3/h- Consumer(s) who do not have a signature on the contract but participate in the service subject to the contract are deemed to have accepted and undertaken the terms of the contract when the consumer(s) they have assigned to register on their behalf read and sign this contract. The contract sent by the agency to the consumer's fax, e-mail etc. contact addresses, voucher and The receipt will be signed by the consumer and sent back to the agency. If it is not sent within 24 hours, they are deemed to have accepted and undertaken the provisions of this contract. In order for the cancellation insurance to be valid, this contract must be signed by the consumer and sent to the agency.

3/ı- In accordance with Article 12 of Law No. 1618; If a package tour service is purchased, the situation where the package tour is missing or not provided at all is covered by insurance. Coverage is as much as the package tour price.

3/j- If the consumer wishes, before the start of the package tour and/or accommodation service; In case of accident or illness, the costs of returning to the starting point, damage arising from any accident and treatment expenses can be insured.

3/k-  In cases where the agency does not fully or partially comply with the contract, the articles of TURSAB MARMARIS CHART are applied in calculating the compensation to be paid.
